Summary:

In the aftermath of the 2025 presidential election, this article explains the polarisation of Polish politics and its gradual right-wing shift, taking migration policy as an example. Faced with a head of state with an illiberal profile, we need to examine the strength of the safeguards, mainly judicial. The use of the right of veto - the main constitutional prerogative available to the President - is examined. The weight of judicial institutions must be put into perspective because of the legal dualism that has persisted since the period of the PiS (Law and Justice) governments. The demonstration shows that it is difficult to preserve the strength of the law when it has been partly delegitimised by successive governments.
