Thesis project
Provisional title of thesis: "The application of environmental law: the case of industrial pollution in the Bouches-du-Rhône département".
Summary : Against a backdrop of increasing local, national, European and international commitments to protect the environment and prevent public health risks, environmental offences are still the least penalised of all types of prosecutable offence. This finding raises questions, and we propose to use an interdisciplinary approach combining law and sociology to analyse the effectiveness of the application of environmental standards. Choosing industrial pollution as the subject of study has the added theoretical advantage of studying offences committed by actors who are particularly well integrated economically. The fact that our study is based in the Bouches-du-Rhône department will enable us to carry out an in-depth analysis of a highly industrialised area such as the area around the Etang de Berre. To do this, we will combine statistical methods and field surveys (observations and interviews) with players involved in the various stages of the process of regulating these offences. We will study the practices of administrative and judicial control agents on the one hand, and the mobilisation of civil society and local elected representatives on the other.
